Governing Law: Republic of Zambia
By making a booking with Nekacheya Travel & Tours, you confirm that you have read, understood, and agreed to the following terms and conditions. These terms form a binding agreement between you and Nekacheya Travel & Tours.
1. Rates & Payments
- All rates are quoted in United States Dollars (USD) unless otherwise stated.
- Payments in Zambian Kwacha (ZMW) are accepted at the prevailing Bank of Zambia mid-rate on the day of payment.
- Rates are subject to availability. If operating costs increase by more than 20% after a quote is issued, rates may be revised — however, confirmed bookings with deposits paid will be honoured at the quoted rate.
- A non-refundable deposit of 20% is required to secure any booking.
- The full balance is due no later than 60 days prior to the travel date. Failure to pay by this deadline may result in automatic cancellation.
- Submitting payment constitutes acceptance of these Terms & Conditions.
2. Booking Confirmation
- A booking is only confirmed once written acknowledgment from Nekacheya Travel & Tours and the required deposit payment have both been received.
- Group bookings and special-function bookings must be confirmed in writing.
- Any amendments to travel dates, group size, or selected activities must be submitted in writing and are subject to availability and possible rate adjustments.
3. Cancellations & Refunds
All cancellation requests must be submitted in writing. The following fees apply based on the notice period before the scheduled travel date:

Please note:
- No refunds are issued for unused services, late arrivals, or early departures once a trip has commenced.
- If Nekacheya Travel & Tours cancels a trip (e.g., due to insufficient numbers), a full refund will be offered where alternative dates or activities are not acceptable to the guest.
- Where subcontracted or third-party suppliers are involved, their own cancellation and refund terms will additionally apply.
4. Children
- Child rates apply as specified for each individual safari or tour package.
- All children must be accompanied by a parent or legal guardian at all times.
- Parents or guardians are required to sign the relevant indemnity forms on behalf of minors before participation in any activity.
5. Travel Insurance
Comprehensive travel insurance is mandatory for all guests. Your policy must cover, at minimum:
- Medical emergencies and hospitalisation
- Emergency evacuation and repatriation
- Trip cancellation and curtailment
- Loss, theft, or damage of baggage, money, and personal effects
Guests are solely responsible for ensuring they hold valid, adequate insurance prior to travel. Nekacheya Travel & Tours accepts no liability for any costs arising from insufficient or absent insurance coverage.
6. Health, Safety & Liability
- All safaris and tours involve inherent risks associated with wildlife, outdoor environments, and adventure activities. Participation is entirely at the guest's own risk.
- Nekacheya Travel & Tours, its directors, employees, guides, and agents accept no responsibility for death, injury, illness, loss, damage, or delay caused by circumstances beyond our reasonable control.
- Guests may be required to sign an indemnity or liability waiver form prior to participating in certain activities. Failure to do so may result in exclusion from the activity.
7. Travel Documentation
- Guests are fully responsible for ensuring they hold valid passports, visas, vaccination certificates, and all other documentation required for entry into Zambia and any other destination on their itinerary.
- Nekacheya Travel & Tours is not liable for any costs, losses, or cancellations arising from incomplete, invalid, or missing travel documentation.
8. Force Majeure
Nekacheya Travel & Tours shall not be held responsible for delays, alterations, or cancellations resulting from circumstances beyond its reasonable control, including but not limited to:
- Adverse weather conditions or natural disasters
- Pandemics, epidemics, or public health emergencies
- Strikes, civil unrest, or political instability
- Government travel restrictions or regulatory changes
In such events, we will make every reasonable effort to reschedule travel or offer suitable alternatives.
9. COVID-19 & Health Emergencies
Our standard cancellation policy applies in all circumstances. However, where travel is prevented by government-imposed restrictions — including entry bans or mandatory quarantine — we may, at our discretion, offer flexible date changes rather than apply cancellation fees.
Any rescheduled bookings will be subject to availability and applicable seasonal rate adjustments at the time of rescheduling.
10. Governing Law
These Terms & Conditions, and all bookings made with Nekacheya Travel & Tours, are governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising shall be subject to the exclusive jurisdiction of the Zambian courts.
